If you do not agree to these Terms, please do not use the Services.
Nothing in these Terms is intended to exclude or limit any consumer rights that cannot legally be excluded or limited under applicable law.
1) About My Phone Guard:
“My Phone Guard” is a mobile device security and protection application designed to help users detect suspicious activity, discourage unauthorized handling of their devices, receive alerts, and maintain records of certain security-related events.
Depending on your device, operating system, permissions, subscription plan, and the version of the application, My Phone Guard may provide features such as:
- Anti-Sneak: Helps detect and record certain unauthorized access attempts involving your device.
- Anti-Theft: Detects certain movements or handling of your device and may trigger a security alert.
- Charging Guard: Helps detect when a device is disconnected from a charger while the relevant protection is enabled.
- AirPod / Headset Protect: Where supported, alerts you to certain unexpected disconnections involving compatible audio accessories.
- Protection Modes: Allows you to select Alarm, Silent, or Discreet responses.
- Alert Vault: Stores and organizes supported security events, incident records, and captured evidence.Intruder
- Photo Capture: May capture photographic evidence when certain protection events occur, subject to device capabilities and permissions.
- Remote Protection: Where available, allows authorized users to access supported remote security and recovery functions.
- Location and Safe Zone Features: May provide location-related alerts, trusted-place settings, or supported device-location functionality.
- Cloud Backup and Restore: Where available, allows eligible users to back up and restore supported information.
- Security Controls: May include application passcodes, biometric authentication, Guided Access instructions, PIN protection, and additional account security.
- Automation and Customization: May include timers, sensitivity settings, automatic protection options, alert preferences, and notification controls.
The specific features available to you will depend on the application version, platform, device compatibility, subscription status, and applicable permissions.
We may introduce, modify, replace, or discontinue features over time, subject to applicable law and any commitments made to existing subscribers.
Features described in promotional materials or future product announcements are not guaranteed to be available unless they have been released in the version of the Services you are using.
2) Eligibility and Authorized Use
You may use My Phone Guard only if you are legally permitted to do so under the laws applicable to you.
The Services are not intended for children under 13 years of age. If you are below the age of majority in your jurisdiction, you must have the permission of a parent or legal guardian to use the Services where required by law.
You agree that you will use "My Phone Guard" only:
- On devices that you own or are legally authorized to protect and administer.
- For legitimate personal security, device protection, and recovery purposes.
- In compliance with applicable privacy, surveillance, recording, and data-protection laws.
- In a manner that does not violate the rights, safety, or privacy of others.
You must not use "My Phone Guard" to unlawfully monitor, stalk, harass, intimidate, or obtain information about another person.
Having physical access to a device does not necessarily mean that you have legal authority to monitor its users, collect their information, or activate recording features.
Where consent, notice, or other authorization is legally required, you are responsible for obtaining it before activating the relevant functionality.
3) Account Registration and Authentication
"My Phone Guard" may allow you to access certain features without creating an account.
An account may be required for features involving cloud storage, remote protection, device recovery, or synchronization across supported devices.
Depending on availability, you may register or sign in using:
- Email verification or one-time passwords.
- Google Sign-In.
- Sign in with Apple.
- Other authentication methods supported by "My Phone Guard".
When an account is created, "My Phone Guard" assigns a unique internal user identifier to the account.
Your account may support more than one verified sign-in method. Linking multiple authentication methods does not necessarily create multiple accounts or separate subscriptions.
You agree to provide accurate information where requested and to keep your account information reasonably current.
You are responsible for maintaining the confidentiality of your account credentials and for activities carried out through your account, except where those activities result from circumstances for which we are legally responsible.
If you believe your account or authentication credentials have been compromised, contact us promptly at support@"My Phone Guard".com.
We may require additional identity verification before processing sensitive account changes, remote recovery requests, subscription ownership disputes, or device transfers.
4) Account-Free Access and Free Incidents
"My Phone Guard" may offer a limited free experience without requiring account registration.
Where the five-incident free allowance is offered, an eligible user may receive up to five free protection incidents across applicable protection features.
A protection incident generally refers to a qualifying security event recognized and counted by "My Phone Guard" under the relevant feature's operating rules.
The free incident allowance is shared across applicable protection modes rather than being separately provided for each mode.
Creating an account, changing authentication methods, signing out, or signing into another account does not automatically restart or increase an already-used free incident allowance.
We may use permitted account, device, installation, or entitlement records to maintain free usage limits and prevent misuse, as explained in our Privacy Policy.
After the free incident allowance is exhausted, users may continue to open and browse available parts of the application, review applicable settings, grant permissions, create an account, and access subscription information.
However, starting or continuing protection that would generate additional incidents, as well as accessing features reserved for paying users, may require an active Pro entitlement.
"My Phone Guard" does not require users to purchase Pro simply to open or browse the application after their free incidents have been used.
Free access, promotional allowances, and trial eligibility may vary by platform, offer, or region and are subject to applicable law.
5) "My Phone Guard" Pro and Paid Features
"My Phone Guard" may offer paid access through recurring subscriptions or other eligible in-app purchases.
Available purchase options may include monthly, annual, and, where offered, lifetime access.
The benefits of Pro may include expanded protection usage, additional evidence storage, cloud-related services, remote features, and other functionality identified on the applicable purchase screen.
The benefits available under a particular plan are those described in the application at the time of purchase, subject to these Terms, applicable platform rules, and any mandatory consumer rights.
Certain features may require additional setup, permissions, account verification, compatible hardware, or network access even after Pro has been purchased.
Purchasing Pro does not automatically grant access to a feature that requires a separate security setup or that is unavailable on the customer's device.
6) Subscription Purchases and Billing
Purchases made through the Apple App Store or Google Play are generally processed by the applicable platform.
The subscription price, billing currency, billing period, and any applicable promotional terms will be shown before you confirm your purchase.
Monthly and annual subscriptions automatically renew unless canceled in accordance with the applicable platform's procedures.
For recurring subscriptions, the applicable platform may charge your payment method at the beginning of each new billing period.
You authorize the applicable platform to process recurring payments according to the terms shown when you subscribe.
We do not normally receive or control your complete Apple Account or Google payment credentials.
Taxes, currency conversion, and platform-specific billing terms may apply.
We may change subscription pricing or available plans from time to time. Any changes affecting an existing subscription will be handled in accordance with applicable law and the relevant app store's notification and consent requirements.
7) Free Trials and Promotional Offers
We may offer free trials, promotional subscription pricing, redemption codes, or limited-time offers to eligible users.
Trial availability, duration, eligibility requirements, and applicable billing terms will be displayed when the offer is presented.
Unless otherwise stated, a subscription trial that automatically converts into a paid subscription will begin charging at the end of the trial period unless canceled before the applicable deadline.
Not all users will qualify for every promotional offer.
We reserve the right to limit promotional eligibility and address fraudulent or abusive use, subject to applicable law.
Promotional subscription trials are separate from the five free protection incidents, unless an offer expressly states otherwise.
8) Subscription Cancellation and Refunds
You may cancel an automatically renewing subscription through the platform where it was purchased.
For Apple subscriptions, you can generally manage your subscription through your Apple Account subscription settings.
For Google Play subscriptions, you can generally manage your subscription through Google Play's subscription management settings.
Uninstalling "My Phone Guard", signing out, or deleting a "My Phone Guard" account does not automatically cancel an active subscription managed by Apple or Google.
When you cancel a recurring subscription, access will generally continue until the end of the paid billing period, unless the platform's rules, a refund, or applicable law provide otherwise.
Refund requests for purchases processed by Apple or Google are generally handled under the applicable platform's refund procedures and any mandatory consumer protection laws.
We do not guarantee approval of a refund request.
If a purchase is refunded, reversed, revoked, or found to be fraudulent, the corresponding paid entitlement may be adjusted or removed as permitted by applicable law.
Users retain all rights to refunds or remedies that cannot legally be excluded.
9) Subscription Ownership and Protected Devices
"My Phone Guard"'s standard individual Pro offering is intended to support one "My Phone Guard" account and one active protected device at a time, unless a different entitlement is expressly included with the purchased plan.
A Pro purchase may initially be made without creating a "My Phone Guard" account.
In that situation, eligible local Pro features may become available following successful purchase verification.
When the purchase is subsequently connected to a "My Phone Guard" account, that account becomes the designated owner of the corresponding "My Phone Guard" entitlement.
Once a purchase is linked to an account, it cannot be automatically reassigned to another account simply because a different person signs in on the same phone or uses the same Apple or Google payment account.
The purchase may be subject to verification and account recovery procedures if a customer disputes an existing ownership link.
Sharing an Apple Account, iCloud account, Google Account, or payment method does not automatically authorize multiple "My Phone Guard" accounts or protected devices to use the same individual entitlement simultaneously.
These account and device limitations concern "My Phone Guard's" service entitlement and do not override any rights to purchase restoration or other rights provided by the applicable app store or mandatory law.
10) Device Replacement and Protection Transfer
We understand that users may replace, upgrade, lose, reset, or repair their devices.
Where supported, "My Phone Guard" allows an eligible Pro user to transfer their active protected-device entitlement to another compatible device while retaining the same "My Phone Guard" account and purchase ownership.
A device transfer may require:
- Signing into the account associated with the entitlement.
- Verification of account ownership.
- Confirmation of the replacement device.
- Reconfiguring local permissions and protection settings.
- Completing additional security checks.
When a new device is activated as the protected device, the previously assigned device may lose the ability to use Pro protection under that same individual entitlement.
Moving a protected-device entitlement does not necessarily transfer locally stored evidence, photographs, settings, or other information.
Where Cloud Backup is available, restoration depends on the backup configuration, successful synchronization, data availability, and applicable security requirements.
Device transfer does not automatically transfer ownership of the subscription to another "My Phone Guard" account.
We may apply reasonable safeguards against unauthorized or abusive transfers.
11) Remote Protection and Remote Access
Where available, Remote Protection enables authorized users to access supported security and recovery functionality relating to a registered protected device.
Depending on the platform, permissions, device capabilities, and subscription plan, remote functions may include:
- Locating or requesting location information from a protected device.
- Triggering supported alerts or alarms.
- Issuing compatible device security or recovery commands.
- Requesting supported photographs, audio, or incident information.
- Accessing cloud-synchronized information.
- Managing approved remote recovery settings.
Remote Protection may require an active Pro entitlement, a registered "My Phone Guard" account, verified remote credentials, explicit permissions, and completion of security setup.
Not all remote functions are available on all devices or operating systems.
Remote commands may fail, be delayed, or remain unavailable when the protected device is powered off, disconnected, out of coverage, restricted by the operating system, has required permissions disabled, or is otherwise unable to communicate with the Services.
A remote request being submitted or accepted does not guarantee that the requested action has been completed on the protected device.
"My Phone Guard" does not guarantee that a lost or stolen device can be located, locked, recovered, or prevented from being accessed by another person.
Remote Protection is intended to assist with authorized device security and recovery. It is not a substitute for Apple's Find My, Google's device-finding services, law enforcement assistance, or any other necessary recovery measures.
12) Remote Access Credentials and Recovery
"My Phone Guard" may allow users to configure a Remote Access email that differs from the email or authentication method used for their primary "My Phone Guard" account.
The Remote Access email is an additional verified sign-in or recovery method associated with the same "My Phone Guard" account. It does not create a second subscription owner.
Depending on the available configuration, users may be permitted to create:
- A Remote Access password.
- A Remote Access PIN.
- Both a password and PIN.
- Additional recovery credentials or codes, where supported.
You are responsible for selecting credentials that are difficult for unauthorized persons to guess and for keeping those credentials confidential.
You must not knowingly provide remote credentials to anyone who is not authorized to control your protected device.
For security reasons, repeated unsuccessful authentication attempts may result in temporary delays, additional verification requirements, restricted remote access, or account recovery procedures.
If you forget your credentials, recovery may be available through a previously verified email address or another approved recovery method. If you lose access to all configured credentials and recovery methods, "My Phone Guard" may be unable to restore your access immediately or at all.
We may decline or delay a recovery request where ownership cannot be reasonably verified.
Providing proof of payment alone may not be sufficient to establish authorization to access private evidence or issue commands to a protected device.
13) Alert Vault, Incident Records, and Evidence
My Phone Guard may record security-related information when supported protection features are active.
Depending on your settings and permissions, incident records may include timestamps, the triggered protection mode, device activity information, photographs, location metadata, or other supported event details.
The Alert Vault is designed to help users review supported events and evidence. However, the availability, completeness, and accuracy of a particular incident record may depend on:
• The type of event detected.
• The device's camera and sensor capabilities.
• Available system permissions.
• Operating-system restrictions.
• The application's execution state.
• Storage availability and device performance.
• Applicable privacy and security settings.
Not every event will generate a photograph or other evidence. Captured photographs may be incomplete, blurred, obstructed, or may not clearly identify the person or activity involved.
An alert or incident record does not, by itself, establish that a theft, criminal act, or unauthorized access has occurred. You are responsible for interpreting and using incident information appropriately.
We do not guarantee that evidence captured through My Phone Guard will be accepted as admissible evidence in courtor any other legal proceeding.
You must not alter, publish, distribute, or use evidence in a manner that violates applicable law or the privacy rights ofothers.
14) Camera, Microphone, Location, Contacts, and Other Permissions
Certain features may require permission to access device capabilities or sensitive information.
Depending on the features offered and activated, these permissions may include access to:
• Camera functionality.
• Microphone or audio functionality.
• Device location.
• Notifications.
• Photos or local storage.
• Bluetooth or connected accessories.
• Contacts, where expressly needed for a supported feature.
• Motion sensors or device activity information.
• Biometric or device authentication.
• Background operation or other operating-system capabilities.
We aim to request permissions in connection with the features that require them.
Your permission decisions may affect how the Services function.
Disabling or refusing a permission may cause the related feature to operate with reduced functionality or become unavailable.
You remain responsible for ensuring that you have the legal right to activate any recording, location, contact-access, or monitoring feature.
Some jurisdictions require consent from one or all parties before recording audio, capturing images, or monitoring particular activities.
My Phone Guard must not be used to bypass those legal requirements.
For additional information about our handling of personal information, please refer to our Privacy Policy.
15) Cloud Backup, Synchronization, and Data Restoration
Where available, Cloud Backup may allow eligible users to store supported account information, settings, incidentrecords, or evidence using cloud infrastructure.
Cloud Backup may require:
• A registered My Phone Guard account.
• An eligible subscription or feature entitlement.
• Sufficient storage availability.
• A compatible device.
• A working network connection.
• Appropriate security permissions.
Cloud Backup and local Alert Vault storage are separate capabilities.
Information saved locally is not necessarily backed up automatically.
Users should review the application's synchronization status before assuming information has been uploaded successfully.
Although we employ reasonable technical and organizational safeguards, we cannot guarantee uninterrupted cloud availability or that every backup or restoration operation will complete successfully.
Synchronization conflicts, connectivity problems, device restrictions, account issues, software errors, or service interruptions may delay or prevent backups.
Deleting local information, deleting cloud information, switching devices, uninstalling the application, or deleting anaccount may affect data availability.
Users should retain independent copies of important records where practical and legally permitted.
The handling, retention, storage locations, and deletion of cloud data are further described in our Privacy Policy.
16) Guided Access and iOS Operating-System Restrictions
On supported Apple devices, My Phone Guard may provide instructions for using Apple's Guided Access feature as an additional measure to help keep the application visible while protection is active.
Guided Access is an Apple operating-system feature and is controlled by the user and Apple, not by My Phone Guard.
The user may need to configure system settings, authentication methods, and accessibility shortcuts before using it.
Guided Access may restrict navigation, application switching, certain authentication methods, and access to other devicefeatures while it is active.
The availability and behaviour of Guided Access may vary depending on the iPhone model, operating-system version, and selected accessibility settings.Users should familiarize themselves with the procedure for ending Guided Access before leaving their device unattended with protection active.
Guided Access is optional and does not guarantee that a device cannot be stolen, powered off, damaged, or otherwise interfered with.
My Phone Guard cannot override all restrictions imposed by iOS.
Other features, including camera access, biometric verification, background monitoring, and automated protection, mayalso be restricted by the operating system.
Users must follow the instructions displayed within the application and the relevant device operating system.
17) Alarms, Notifications, and Detection Accuracy
My Phone Guard provides alerts and security responses based on supported detection rules and device signals.
A security event may trigger an audible alarm, visible alert, silent notification, or other configured response.
The detection and response may be affected by device sensitivity settings, motion, background conditions, charging status, network connectivity, system settings, and other circumstances.
False alerts may occasionally occur.
An alert may also be delayed or fail to trigger under certain conditions. Users should test and configure their preferredsettings before relying on a protection mode in a particular environment.
Audible alarms may be loud or disruptive. Users should consider their surroundings and use appropriate alert settings.
The user remains responsible for determining whether it is safe and appropriate to activate audible protection in a given location.
My Phone Guard does not guarantee that alerts will deter every unauthorized person or prevent every attempted theft or intrusion.
18) Safe Zones, Trusted Places, and Location-Based Features
Where available, users may configure Safe Zones, Trusted Places, or location-related protection rules.
Such features may rely on GPS, Wi-Fi, mobile networks, operating-system location services, or other device information.
Location readings may be approximate, delayed, or inaccurate.
Geofencing and trusted-location behaviour may be affected by battery-saving settings, connectivity, environmental conditions, or permission restrictions.
A device appearing to be within or outside a defined location does not guarantee its actual physical position.
Users are responsible for configuring appropriate location boundaries and understanding the resulting protection behaviour.
My Phone Guard does not provide emergency tracking guarantees.
19) Authentication, Vault PIN, and Device Security
My Phone Guard may offer additional security measures such as application passcodes, Vault PINs, biometric verification, Remote Access PINs, and account authentication.
These controls may serve different purposes and should not be assumed to be interchangeable.Users are responsible for maintaining the confidentiality of their security credentials.
Where biometrics are supported, their availability depends on the device's operating system and authentication settings. Biometric authentication may become unavailable in certain operating-system states, including certain Guided Access configurations.
Users should maintain any required alternative authentication method.
My Phone Guard may restrict access or require additional verification when suspicious activity or repeated failed authentication is detected.
No authentication system is completely immune to unauthorized access.
20) User Responsibilities and Prohibited Activities
You agree not to:
• Use My Phone Guard to stalk, harass, unlawfully surveil, threaten, or intimidate another person.
• Activate remote commands on a device you do not own or have authority to manage.
• Record individuals unlawfully or violate applicable consent requirements.
• Access another user's account, private evidence, or recovery information without authorization.
• Attempt to bypass subscription limits, device restrictions, security checks, or authentication controls.
• Create accounts or manipulate device installations primarily to obtain unauthorized additional free allowances.
• Reverse engineer, modify, distribute, or exploit the Services except where permitted by applicable law or relevantopen-source licenses.
• Interfere with our servers, communications, application security, or other users.
• Use automated systems to abuse remote commands or overload the Services.
• Submit fraudulent payment, subscription, refund, or ownership claims.
• Use the Services for any unlawful purpose.
We may investigate suspected misuse and take proportionate action permitted by law, including limiting access, suspending accounts, or restricting particular features.
Where legally required or reasonably appropriate, we will provide notice and an opportunity to appeal or resolve an issue.
21) Third-Party Services and Platforms
My Phone Guard may rely on third-party platforms and services, including Apple, Google, cloud service providers, authentication providers, notification services, analytics providers, and payment processors.
These services may be subject to their own terms, policies, and technical restrictions. We are not responsible for the independent operation of third-party services except to the extent required by applicable law or where responsibility arises from our own acts or omissions.
Changes made by Apple, Google, or other platform providers may affect feature availability, billing, permissions, authentication, or compatibility.
Nothing in these Terms reduces any rights you may have against the applicable third-party provider.
22) Availability, Updates, and Maintenance
We aim to maintain reliable access to My Phone Guard but do not guarantee that the Services will always be uninterrupted, error-free, or available on every device.
We may release updates to improve performance, security, compatibility, features, or compliance.
Some updates may be required to continue using account-based or remote services securely.
Scheduled maintenance, unexpected outages, system failures, network interruptions, or third-party platform changesmay temporarily affect availability.
Where practicable, we will provide reasonable information about material service changes.
We will not materially reduce paid functionality in a manner that violates applicable law or our binding commitments to customers.
23) Account Suspension and Termination
You may stop using My Phone Guard at any time.
You may also request deletion of your My Phone Guard account using the available account-deletion process.
We may suspend or terminate access where reasonably necessary due to:
• Serious violations of these Terms.
• Fraudulent or unauthorized account activity.
• Security threats involving the account or Services.
• Legal or regulatory obligations.
• Misuse of remote access or surveillance-related functionality.
Any action we take will be subject to applicable law, including mandatory consumer rights. Suspension or termination of a My Phone Guard account does not automatically cancel an independently managed Apple or Google subscription.
24) Account Deletion and Data Removal
Users may request deletion of their My Phone Guard account and associated personal data in accordance with our Privacy Policy and applicable law.
Account deletion may result in loss of access to cloud-stored information, remote device connections, account-specific settings, and other data associated with the deleted account.
Some records may need to be retained where required or permitted for legal compliance, security, fraud prevention, financial records, or dispute resolution.
Before deleting an account, users should review any active subscription and cancel recurring billing separately throughthe applicable purchase platform if they no longer wish to be charged.
Deleting an account does not automatically create a right to receive a refund or transfer a previously claimed subscription to a different account. Statutory rights and applicable platform restoration procedures remain unaffected.
For account deletion assistance, contact support@myphoneguard.com or use the account-deletion options made available through the Services.
25) No Guarantee of Theft Prevention or Device Recovery
My Phone Guard is a supplementary security tool.
Although the Services are intended to improve awareness and assist with device protection, they cannot eliminate all security risks.
We do not guarantee that:
• Your device will never be stolen or accessed without permission.
• Every suspicious event will be detected.
• Every alarm will prevent a theft.
• Every intruder will be photographed or identified.
• Every event will produce a complete or accurate incident record.
• A lost device can always be located or recovered.
• Remote commands will always execute successfully.
• Your data will never be lost, corrupted, or accessed without authorization.
Users should continue to use operating-system security measures, secure passcodes, device-finding features, account recovery methods, and appropriate physical precautions. My Phone Guard is not an emergency-response or law-enforcement service.
If you believe you are in immediate danger or a crime is taking place, contact the appropriate emergency services orauthorities.
The availability of any protection mode, alarm, evidence capture, location request, cloud service or remote recoveryfunction does not constitute a promise that a device will be protected against every threat or successfully recovered. If a device is stolen, lost, damaged or accessed without authorization despite use of the Services, or if a feature does not activate, detects an event incorrectly, produces incomplete evidence, or a remote command fails or arrives too late, that outcome alone does not establish a guarantee breach or liability on the part of My Phone Guard. Service performance may depend on device condition, iOS or Android restrictions, permissions, background execution, battery level, chargingand network status, and other circumstances beyond our control. Users should maintain independent device security and recovery arrangements and take appropriate safety precautions.
26) Account Deletion and Data Removal
My Phone Guard and its associated software, designs, graphics, names, logos, interfaces, and other proprietary materials are owned by or licensed to Cellusion Tech FZE and are protected by applicable intellectual-property laws.
Subject to these Terms and the applicable app store's usage rules, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use the application for lawful personal purposes.
This license does not transfer ownership of the software or its intellectual property to you.
You must not reproduce, distribute, sublicense, commercially exploit, or create unauthorized derivative works of protected materials except where expressly permitted by law or applicable licenses.
27) User Content and Evidence Ownership
As between you and My Phone Guard, you retain any ownership rights you lawfully hold in the photographs, recordings, incident information, or other content generated or stored through your use of the Services.
You grant us a limited right to process, store, transmit, and otherwise handle such content only as reasonably necessary to provide the features you request, maintain the Services, comply with applicable law, and carry out the purposes disclosed in our Privacy Policy.
We do not claim ownership of your private incident photographs merely because they are stored through My PhoneGuard.
You are responsible for ensuring that the content you capture, upload, store, or share does not violate the rights of others.
28) Privacy and Data Protection
Your privacy is important to us.
Our Privacy Policy explains the categories of information we collect, how information is used, where it may be stored, when it may be shared, how long it may be retained, and the choices available to you. Please review our Privacy Policy at:
https://myphoneguard.com/privacy-policy
These Terms and the Privacy Policy should be read together.
If any provision of these Terms conflicts with mandatory data-protection law, the applicable law will prevail.
29) Disclaimers and Limitations of Liability
To the maximum extent permitted by applicable law, the Services are provided on an "as available" basis, subject to any express commitments we make and any warranties or guarantees that cannot legally be excluded.
We do not make guarantees beyond those expressly stated in these Terms or required by law regarding uninterrupted operation, security detection accuracy, evidence capture, remote recovery, device compatibility, or fitness for a particular purpose.
To the maximum extent permitted by applicable law, we are not responsible for losses arising solely from circumstances outside our reasonable control, including third-party network failures, unsupported operating-system behaviour, or a user's unlawful or unauthorized use of the Services.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury, or any other matter where exclusion or limitation is prohibited by applicable law.
Nothing in these Terms removes any statutory consumer guarantee, refund entitlement, or legal remedy available to you.
Any additional contractual monetary liability cap must be reviewed and approved under the laws governing the Services before being added.
To the maximum extent permitted by applicable law, Cellusion Tech FZE will not be liable for indirect, incidental, special or consequential losses arising from undetected incidents, unsuccessful theft prevention, unsuccessful or delayed device recovery, failed or delayed remote commands, unavailable alerts, missed evidence capture, or interruption of protection, including loss of a device, loss of data, or loss of use, where such limitations are legally permitted. This limitation doesnot apply where liability is established for our negligence, breach of a non-excludable statutory guarantee, willful misconduct or another circumstance for which applicable law prohibits a limitation or exclusion of liability. Nothing inthese Terms prevents users from bringing legitimate complaints or exercising applicable consumer, privacy, warranty or refund rights.
30) Indemnification
To the extent permitted by applicable law, you agree to be responsible for third-party claims, losses, or expenses arising from your intentional unlawful use of My Phone Guard, material breach of these Terms, or unauthorized surveillance or remote access conducted through your account.
This provision does not require you to indemnify us for losses caused by our own negligence, unlawful acts, security failures for which we are responsible, or other circumstances where indemnification is prohibited by law.
31) Changes to These Terms
We may update these Terms to reflect product changes, new functionality, legal requirements, security improvements, or changes to our operating practices.
When we make material changes, we will provide appropriate notice through the application, website, email, or other reasonable means where required by law.
The updated Terms will display a revised effective date.
If applicable law requires your consent to a particular change, we will seek that consent before the change becomes binding.
Your continued use of the Services after a valid update takes effect may constitute acceptance where permitted by law.
If you disagree with updated Terms, you may stop using the Services and exercise any cancellation or other rights available to you.
32) Governing Law and Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates, excluding conflict-of-law rules, except where mandatory consumer protection laws require otherwise.
If you have a concern or dispute regarding My Phone Guard, please contact support@myphoneguard.com so we can attempt to resolve the matter.
If the matter cannot be resolved informally, disputes may be pursued through the courts or other processes having jurisdiction under applicable law.
Nothing in these Terms prevents consumers from exercising rights or bringing claims in a jurisdiction where applicable mandatory law permits them to do so.
33) General Provisions
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent legally permitted.
Our failure to enforce a provision on one occasion does not mean we waive the right to enforce it later.
You may not transfer your rights under these Terms without our consent, except where applicable law permits otherwise. We may assign these Terms in connection with a lawful merger, acquisition, reorganization, or transfer of the Services, subject to applicable consumer and privacy rights.
These Terms, together with the Privacy Policy and any applicable subscription or promotional terms, form the agreement governing your use of My Phone Guard.
